1. ACCEPTANCE OF TERMS

By accessing or using the Looping app ("the App"), you agree to be bound by these Terms of Use. If you do not agree, do not use the App. These terms apply to all learners, educators, and organisations accessing the App.

2. ACCESS AND ACCOUNTS

Access to the App is granted by your organisation, educator, or through a consumer account created directly with Looping EduTech. You are responsible for maintaining the confidentiality of your login credentials. You must not share your account or allow others to access the App using your credentials.

3. AUTHORISED USE

The App is provided solely for the purpose of completing Looping immersive learning and assessment modules. You agree not to:

  • Use the App for any unlawful purpose.

  • Attempt to reverse engineer, copy, reproduce, or extract any content from the App.

  • Attempt to gain unauthorised access to any part of the App, its backend systems, or other users' accounts.

  • Transmit any malicious software, viruses, or harmful content through the App.

4. INTELLECTUAL PROPERTY

All content within the App — including immersive scenarios, assessments, learning materials, AI-generated interactions, and the Assessment Convergence Model™ — is the exclusive intellectual property of Ninefiftysix Pty Ltd. No content may be copied, reproduced, distributed, or republished without prior written consent from Looping EduTech.

5. ASSESSMENT AND QUALIFICATIONS

Looping EduTech is a technology platform provider and is not an educational institution. The App facilitates immersive learning and generates assessment evidence portfolios; however, all final assessment decisions, competency determinations, and the issuance of qualifications, certificates, or credentials remain the sole responsibility of the relevant educator, assessor, or educational institution.

6. PRIVACY

Your use of the App is subject to our Privacy Policy, which forms part of these Terms of Use. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.

7. AVAILABILITY AND CHANGES

Looping EduTech reserves the right to modify, suspend, or discontinue any aspect of the App at any time. We will endeavour to provide reasonable notice of significant changes where possible.

8. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Looping EduTech and Ninefiftysix Pty Ltd are not liable for any direct, indirect, incidental, or consequential loss arising from your use of, or inability to use, the App or its content.

9. GOVERNING LAW

These Terms of Use are governed by the laws of New South Wales, Australia. Any disputes shall fall under the jurisdiction of the courts of New South Wales.
